RESORT VILLAGE OF SOUTH LAKE
BYLAW NO 1-19
A BYLAW TO PROHIBIT THE RUNNING AT LARGE OF DOGS AND CATS
The Council of the Resort Village of South Lake in the Province of Saskatchewan enacts as follows:
SHORT TITLE
1. This Bylaw may be cited as the Dog and Cat Bylaw.
INTERPRETATION
2. a. "Dog" includes all species of the animal commonly known as dogs, male or female, and of every breed or classification or mixture of breeds;
b. "Cat" shall mean either the male or female of the feline family.
c. "Clerk/Administrator" shall mean the clerk or administrator of the municipality.
d. "Municipality" shall mean the Urban Municipality of the Resort Village of South Lake.
e. "Running at large" shall mean when the dog is beyond the boundaries of the land occupied by the owner, possessor, or harbourer of the said dog; or beyond the boundaries of any lands where it may be with the permission of the owner or occupant of the said land and when it is not under control by being:
(i) in the direct and continuous charge of a person competent to control it; or
(ii) securely confined within an enclosure; or
(iii) securely fastened so that it cannot roam at will.
f. "Owner" shall mean any person, partnership, association or corporation owning, possessing, harbouring, having charge of or control over any dog or cat, and includes a keeper of a dog or cat. "Owner" shall also include the person responsible for the custody of a minor where the minor is the owner of the dog or cat.
DUTIES OF DOG AND CAT OWNERS
3. A person who owns, possesses, or harbours a dog or cat found running at large shall be deemed in violation of this Bylaw.
4. No owner or other person shall use a leash greater that two (2) meters in length on a dog or cat, when such dog or cat is off the premises of the owner, and where a leash greater than two (2) meters in length is used by the owner or any other person, the dog or cat shall be deemed to be running at large.
5. A female dog or cat in heat shall be confined and housed in the residence of the owner or person having control of the dog or cat; or taken to a licensed kennel during the whole period that the dog or cat is in heat; except that a female dog or cat may be allowed outside the said residence for the sole purpose of allowing the dog or cat to defecate on the premises of the owner.
6. Any owner whose dog or cat chases any pedestrian, vehicle, horse or any other animal on a public thoroughfare shall be in violation of this Bylaw.
7. No owner shall permit a dog to create a disturbance by barking, howling or in any other way causing an interference with the lawful use and enjoyment of property by any other person.
8. If a dog or cat defecates on any public or private property other than the property of its owner, the owner of the dog or cat shall remove the defecation immediately.
9. An owner or occupant of private property must not allow animal feces to accumulate on the property.
10. No owner shall permit their dog or cat to damage public or private property.
11. It shall be the responsibility of the owner to arrange for all permits, inspections and certificates required by other applicable Acts and regulations.
PENALTY
12. a. A person who contravenes any of the provisions of this Bylaw, shall be guilty of an offence and upon conviction shall be liable to a fixed penalty of:
(i) $250.00 for a first offence; $500.00 for a second offence; and any third or subsequent offence, the animal will need to be removed from the Village permanently.
b. A violator of this Bylaw, upon being served with a Notice of Violation, may voluntarily pay the penalty at the Municipal Office during regular office hours, and upon payment as so provided, that person shall not be liable to prosecution of the offence.
c. The Notice of Violation shall be in Form "2", attached to and forming part of this Bylaw.
13. Bylaws No. 21-15 is hereby repealed.
14. This Bylaw comes into force and effect upon its passage.
