TOWN OF SOUTHEY
BYLAW NO. 2021-06
BYLAW TO REGULATE THE OPERATION OF VEHICLES
The Council of the Town of Southey, in the Province of Saskatchewan, enacts as follows;
1.
SHORT TITLE:
(a) This Bylaw shall hereinafter be referred to as the "Traffic Bylaw";
2.
INTERPRETATION
In this Bylaw;
(a)
"abandoned vehicle" means a vehicle that has been left or placed on a street, public place or
land or building owned or controlled by the Town of Southey for ten (10) days or more; and
after reasonable inquiry, the owner of the vehicle cannot be ascertained;
(b)
"Administrator" means the Administrator of the Town of Southey;
(c)
"angle parking" means the parking of vehicles with the right front wheel drawn up to the curb
on the right-hand side of the highway, or at a distance of not more than thirty (30) centimeters
from such curb, the vehicle to be placed at an angle of forty-five (45) degrees with the curb;
(d)
"boulevard" means the area between the travelled portion of the highway and limit of the
highway right-of-way, but does not include a gravel shoulder;
(e)
"Council" means the Council of the Town of Southey;
(f)
"curb" means the lateral boundaries of a roadway, whether or not marked by curbing;
(g)
"designated officer" means the Administrator, Royal Canadian Mounted Police or a person
appointed by Council to enforce municipal Bylaws;
{h)
"Fire Chief" means the Fire Chief for the Town of Southey and anyone acting or authorized by
the Fire Chief to act in his/her behalf;
(i)
"heavy vehicle" means a vehicle with or without load which alone or together with any trailer,
semi-trailer or other vehicle being towed, weighs 4.5 tonnes (4,500 kg) or more;
(j)
"highway" means a road allowance or a road, street or lane vested in the Crown in right of
Saskatchewan or set aside for the purpose of the Crown in right of Saskatchewan pursuant to
any Act, and includes anything erected on or in connection with the highway, and does not
include a provincial highway within the Municipality as designated pursuant to the provisions of
The Highways and Transportation Act. 1997;
(k)
"intersection" means the area contained within the straight production of the lateral curb lines,
or in the absence of curb lines, of the lateral boundary lines, of two or more highways that join
one another at an angle, whether or not one of those highways crosses the other;
{I)
"lug vehicle" means any vehicle, portable engine or traction engine having metal spikes, lugs or
cleats projecting from the face of the wheels or tires thereof, or having metal track tread;
(m)
"municipality" means the Town of Southey;
(n)
"one-way highway" means highway as described to it by The Traffic Safety Act;
(o)
"parade" means any procession of more than ten (10) pedestrians or of more than six (6)
vehicles moving upon any highway, except funeral processions;
(p)
"parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to
the curb on the right-hand side of the highway, or at a distance of not more than thirty (30)
centimeters from such curb;
(q)
(r)
(s)
"park" or "parking" have the meanings described thereto by The Traffic Safety Act;
"pedestrian" means a person afoot;

"pedestrian crosswalk" meahs a clearly marked pedestrian crossing, by signs and/or lines; s/
(t)
"place of public assembly" means schools, theatres, moving picture theatres, churches, hockey
and skating rinks, curling rinks, dance halls and public assembly halls;
(u)
"power turn" means to maneuver a vehicle in such a manner to cause part of the vehicle to
depart from its ordinary line of progress by the sudden use of acceleration and/or braking;
(v)
"private roadway" means any private road, private driveway, lane ramp or other means of
vehicle access to or egress from a building or structure and it may include part of a parking lot;
(w)
"sidewalk" means that portion of a boulevard which is paved, bricked or otherwise hard
surfaced and intended for the use of pedestrians;
(x)
"sign" means any sign, curb or sidewalk marking, or other device placed or erected on a
highway for the purpose of regulating, warning, guiding traffic or providing information;
(y)
"speed zone" means any portion of a highway within the Town of Southey, designated herein,
and identified by a sign erected and maintained at each end thereof, indicating the maximum
speed applicable thereto;
(z)
"stop" or "stopping" means the halting of a vehicle, even momentarily, whether occupied or
not, except when necessary to avoid conflict in compliance with the directions of a police officer
or of a control sign or signal;
(aa)
"tow away zone" means a designated area on a highway where parking is prohibited and where
stopped or parked vehicles will be subject to removal and impoundment;
(bb)
"town supervisor" means the Public Works Foreman or the assistant or anyone acting or
authorized by the Municipality to act on their behalf;
(cc)
"U-turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction
from which it was proceeding immediately prior to the commencement of such turn;
(dd)
"vehicle" means a vehicle, trailer or semi-trailer or a vehicle as described to it by The Traffic
Safety Act.
3.
SCOPE
(a)
"STOP" STREETS
The highways as listed in Appendix 1 are designated as "Stop" streets.
(b)
"YIELD" STREETS
The highways as listed in Appendix 2 are designated as "Yield" streets.
4.
INFRACTIONS
(a)
"STOP" STREETS
The provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "Stop"
sign erected and maintained in accordance with the provisions of Section S(a).
(b)
"YIELD" STREETS
The provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "Yield"
sign erected and maintained in accordance with the provisions of Section S(b).
(c)
MISCELLANEOUS SIGNS
(1)
No person shall, except where authorized by resolution of Council or when duly
authorized by law, erect immediately adjacent to any highway; any sign, marker, signal or
light or any advertising sign or device.
(2)
No person shall deface, damage, destroy or remove any sign or marker erected pursuant
to this bylaw.
(d)
SCHOOL BUS FLASHING LIGHTS (Appendix No. 3)
(1)
When traveling in the same direction as a school bus that has its safety lights flashing, and
safety arm activated do not pass the bus;
(2)
When traveling in the opposite direction of a stopped school bus that has its safety lights
and stop are in operation, stop at least 5 meters, from the rear of the bus while the light
and arm are active, and;
(3)
When traveling in the opposite direction of a stopped school bus that has its safety lights
and stop arm in operation, stop at least 5 meters from the front of the bus while the lights
and arm are active, and;
(4)
When stopped for any of the aforementioned reasons; wait until all safety lights and stop
arms are de-activated before continuing to drive past any school bus;
(ff
(5)
This bylaw pertains to all streets, avenues, crescents, parking lots, and boulevards and; or
any place that a school bus is loading or unloading passengers in the Town of Southey.
(e)
LUG VEHICLES
(1)
No person shall propel, operate or drive any lug vehicle upon any highway within the
municipality without first having obtained of the Administrator, a permit in writing
authorizing the same.
(2)
The Administrator is hereby authorized to issue permits in writing for the purpose of
Section 4(e)(l) of this bylaw in any case where the applicant therefore has signed a
written undertaking in Form 1, Appendix 4. Provided that the Administrator shall not
issue any such permit unless they are satisfied that with reasonable care in operation, the
lug vehicle may be propelled or driven over any highway without damage resulting
thereto or to any bridge or culvert thereon.
(3)
Nothing contained in Section 4(e)(l) shall be deemed to preclude the transport of a lug
vehicle as herein defined over any highway where same is being carried by means of a
rubber-tired trailer or other conveyance equipped with rubber tires.
(f)
PARKING
(1)
Except as otherwise provided herein, the parking of vehicles is permitted on all highways
within the municipality.
(2)
{i)
subject to the provisions of subsection (ii) no person shall park a vehicle on any lane,
or on any street so as to obstruct the entrance to any lane or to a driveway or
approach leading to a private premise.
(ii)
notwithstanding the provisions of subsection (i), a vehicle may be parked in any lane
for the purpose of taking on or discharging cargo, provided no such vehicle shall be
parked for a period exceeding thirty (30) minutes at one time, unless written
permission has first been obtained from the Administrator or a designated officer of

(i)
the municipality for an extension of such time limit.
subject to subsection (ii) every person parking a vehicle upon a highway within the
municipality where parking is permitted, shall parallel park same;
(ii)
every person parking a vehicle upon a highway listed in Appendix 5 shall angle park
same.
(4)
Subject to subsection (i), no person shall park a vehicle in any "No Parking" area as
designated in Appendix 6, at any time, whether such areas are marked on the curb or
otherwise signs erected and maintained in accordance with the provisions of Section S(d)
to indicate that therein prohibited parking.
(i)
During a wedding or funeral ceremony, any church or other place of public assembly
may in coordination with the Town Supervisor, erect signs or parking barricades to
designate a temporary parking area in front of the place of public assembly.
(S)
No Person shall park a vehicle within three (3) meters of any street intersection.
(6)
No person shall park a vehicle within three (3) meters of any fire hydrant.
(7)
Subject to subsection (i) no person shall park a vehicle on a highway or boulevard at one
place for any period of time exceeding seventy-two (72) consecutive hours.
(i)
Privately owned and fully licensed recreation camper trailers may be parked on the
boulevard in residential areas from May p
t to September 30th of each year, provided
that they are parked adjacent to the owner's property during this period.
{ii)
Privately owned and fully licensed recreation camper trailers may be parked on the
street with permission from the town, in residential areas from May 1st to
September 30th of each year, provided that they are parked adjacent to the owner's
property during this period.
(iii)
Privately owned and fully licensed trailers may be parked on the street or boulevard
adjacent to the owner's property. If unable to park adjacent to owner's property,
the owner of the trailer must request permission from the property owner or the
Town. Trailers parked on highways or boulevards must be moved within seventy
two (72) hours.
(8)
No person shall park any vehicle in any private parking place or on any private property
unless he is the owner, occupant, licensee, or permittee of the parking place or private
property, except with the consent of such owner, occupant, licensee or permittee.
(9)
(i)
subject to subsection (ii), no person shall par

cle designated for carrying or
intended for the carrying of oil, gasoline, or other inflammable, combustible or
explosive material, within thirty (30) meters from any building in the municipality
used or intended for use, in whole or in part, as a place of dwelling, a hotel or place
of public assembly.
(ii)
nothing in subsection (i) shall be deemed to restrict the parking of any such vehicle
for such period of time as may be necessary to take on or discharge cargo.
(10)
No person shall park a vehicle with a manufacture's rated capacity in excess of 4.5 tonnes
(4,500 kg.) on any streets or avenues designated in Appendix 7.
(11)
No person shall park an unregistered vehicle on any street, avenue, lane or any public
land, which includes a right of way or boulevard.
(12)
No person shall park a vehicle with a sign attached indicating that the vehicle is for sale on
any public lands, including but not limited to a highway, that are not designated for that
purpose.
(13)
No person shall park a vehicle on any highway unless on the right-hand side of the
highway having regard for which direction the vehicle had been proceeding.
(14)
No person shall park a vehicle so as to obstruct any portion of a sidewalk.
(15)
No person shall park a vehicle so as to obstruct the movement of traffic.
(16)
No person shall park so as to obstruct any portion of a pedestrian crosswalk.
(17)
Where a sign has been erected indicating that stopping is prohibited, no person shall park
or stop a vehicle on a highway designated prohibited stopping as described in Appendix
12.
(18)
No person shall park a vehicle on any boulevards containing grass and/or trees.
(19)
Where a sign(s) has been erected indicating that parking is prohibited and the area is
designated as a "tow away zone", no person shall park or stop a vehicle on a highway
designated as "No Parking - Tow Away Zone.
(20)
No person shall park a vehicle in designated Handicap Parking Zones unless the vehicle
displays a handicap placard in the vehicle's front windshield. This does not apply to
Emergency Vehicles.
(g)
POWER TURNS
The operator of a vehicle shall not execute "power turns" on any highway in the municipality.
(h)
SNOWMOBILES
Refer to the Bylaw No. 2-1998, a Bylaw to regulate the operation of snowmobiles within the
limits of the Town of Southey.
(i)
ALL TERRAIN VEHICLES
Refer to the Bylaw No. 1-2018, a Bylaw to regulate the operation of all-terrain vehicles within
the limits of the Town of Southey.
(j)
SPEED
(1)
Subject to subsection (2), no person shall operate a vehicle in the municipality at a speed
greater than forty (40) km/h.
(2)
No person shall operate at a speed greater that thirty (30) km/h in speed zones set out in
Appendix 8.
(3)
The provisions of subsection 1) and 2) shall not apply to the operators of fire engines or
fire department apparatus or to vehicles being operated by law enforcement officers or to
operators of ambulances, where these vehicles are being operated on emergency duty
and employing the siren and flashing lights.
(k)
U-TURNS
No person shall cause a vehicle to make a U-Turn between intersections, and at the intersection
of a highway with a lane or any alley in the municipality.
(I)
WEIGHT RESTRICTIONS - "TRUCK ROUTES"
(1)
Subject to subsection (2) no person shall operate a vehicle or combination of vehicles with
a gross vehicle weight exceeding 10,000 kg on any public highway within the Town of
Southey with the following exceptions:

Heavy Vehicle Route as li'sted in Appendix 9. Maximum axle and gross vehicle
't
weights for secondary highways as set out in the Saskatchewan Vehicle and
Dimension Regulations 1999.
(2)
Subsection (1) shall not apply to vehicles making delivery on any highway in the
municipality provided that the operator of the vehicle uses the most direct route from and
to the truck route, as listed in Appendix 7.
(3)
Subsection (1) shall not apply to vehicles owned and operated by the municipality or issued
a permit from the Administrator.
(4)
The provisions of the The Police Act and The Highways and Transportation Act shall apply
to the operators of the vehicles referred to in subsection (1) and (2).
(m)
VEHICLES ON PUBLIC & MUNICIPAL RESERVES, PUBLIC PARKS, PUBLIC PLACES, ETC.
(1)
No person may operate or park a vehicle on any designated in Appendix 10.
(2)
The provision of Subsection (1) shall not apply to maintenance vehicles or vehicles using a
designated parking area or vehicles being operated by a member of the police force,
designated officer or the persons appointed by Council while engaging in their duties or
person(s) having been given written permission from the Administrator of the
municipality.
(n)
BICYCLES
(1)
No person shall drive or ride a bicycle without at least one hand on the handlebars.
(2)
No person shall ride or drive a bicycle on a sidewalk.
(3)
No person riding a bicycle shall carry more persons than that which the same is designed.
(4)
No person shall ride or drive a bicycle in a recklessly or negligent manner.
(5)
No person shall ride or drive a bicycle in a reclining position on any street or sidewalk in
Town.
(6)
All bicycles must have reflectors if driving at night.
(o)
"EMERGENCY CONTROL MEASURES"
(1)
A designated officer is hereby authorized to direct traffic in conformity with the provisions
of the bylaw and The Traffic Safety Act.
(2)
In case of fire or other emergency, or in order to expedite traffic, or safe guard
pedestrians, or prevent accidents, or meet any unforeseen conditions, a designated officer
or fire chief of the municipality is hereby authorized to direct traffic in such a manner as
he/she may deem necessary whether or not in conformity with the provisions of this
Bylaw or The Traffic Safety Act.
(p)
TEMPORARY CLOSING AND PARKING
(1)
(a)
Any portion of a public highway may be temporarily closed to vehicular traffic by a
designated officer or the Town Supervisor in order that pedestrians may have the
exclusive use thereof.
(b)
Notwithstanding any other provisions of this Bylaw, a designated officer shall have
authority to temporarily prevent parking/and or prohibit traffic on any highway or
portion thereof whenever in his/her judgement it may be necessary in order to
avoid traffic congestion, danger or accident.
(c)
Notwithstanding any other provisions of this Bylaw, the Town Supervisor shall have
authority to temporarily prevent parking and/or prohibit traffic on any highway or
portion thereof to allow any work to be carried out by or on behalf of the
Municipality, such work to include, but not restricted to the snow removal, cleaning,
repairing or maintenance of such highway.
(d)
No person driving a vehicle shall drive through or enter upon any street or portion
thereof, which is roped, barricaded or indicated, by notice or sign as being closed
under the authority of a designated officer or the Town Council.
(e)
No person shall park a vehicle on any highway or portion thereof on which parking
has been temporarily prohibited by a designated officer or the Town Supervisor
under the provisions of subsections (b) or (c) of this Section.
(2)
On days when school is in session, the Robert Southey School is permitted to prevent all
vehicular traffic from accessing Coleridge Street North from the intersections of Burns
Avenue and Coleridge Street and Stewart Avenue and Coleridge Street for ten (10)
minutes at student dismissal -Appendix 3.

(q)
PARADES
(1)
No parade shall be held in the Municipality without the written permission first and
obtained from the Town of Southey who shall designate or approve hour and route of the
parade. Any person desiring to hold a parade shall apply to the Town of Southey in writing
in Form 1, Appendix 13 for a permit therefore not less than forty-eight {48) hours before
the time set for the commencement of the parade and shall give full particulars thereof.
(2)
The Administrator is hereby authorized to issue permits in writing for the purpose of
Subsection (q)(l) of this bylaw Form 2, Appendix 13 and may impose directions or
conditions as to time, route or otherwise.
{r)
RESTRICTED PARKING
(1)
No person shall stop or park a vehicle in an area designated as restricted parking without a
valid parking permit. Permits must be properly displayed on the rear-view mirror of the
vehicle for that designated area. Permits may be obtained from the Town of Southey
Office at a cost of $60.00 per year, per space, and expire December 31st of each year.

HANDICAP PARKING

PENALTIES
(1)
No person shall stop or park a vehicle in an area designated as handicap parking without a
valid parking permit properly displayed in the front windshield. The temporary or
permanent placard must be issued by the Saskatchewan Abilities Council and have a valid
permit number and expiry date.
(a)
Council shall cause to be erected and maintained at all stop streets listed in Appendix 1, at
a distance of approximately three (3) meters from point of intersection, an appropriate
sign containing the word "Stop", so placed to face the traffic approaching the intersection.
(b)
Council shall cause to be erected and maintained at all yield streets listed in Appendix 2,
at a distance of approximately three {3) meters from point of intersection, an appropriate
sign containing the word "Yield", so placed to face traffic approaching the intersection.
(c)
Council may, by resolution, provide for the erection and maintenance on any highway and
at any designated point or points thereon, of such signs as it may deem expedient for
warning, guidance, directions or information thereon.
(d)
Council shall cause to be erected and maintained at all "Restricted Parking" areas as listed
in Appendix 14, appropriate signs and/or curb markings. Such signs or curb markings shall
be visible from that part of the highway to which restriction applies.
(e)
Council shall cause to be erected and maintained at all "Handicap Parking" areas listed in
Appendix 15, appropriate signs and/or curb markings. Such signs or curb markings shall be
visible from that part of the highway to which restriction applies.
(f)
Council may, by resolution, provide for the erection and maintenance on any highway and
at any designated point or points thereon, of such signs as it may deem expedient for
warning, guidance, directions or information thereon.
(g)
The Administrator, in co-operation with the Town Public Works Foreman, shall maintain a
schedule of traffic signs (including warning and information signs) locations in the Town of
Southey and shall ensure that the schedule is open to public inspection.
(a)
SIGNS AND PARADES
Any person who contravenes any of the provisions of subsections 4(c)(1), 4(c)(2), and
4(q)(1) of this bylaw is guilty of an offence or liable on summary conviction to the
penalties provided in the General Penalty Bylaw of the Town of Southey.
(b)
LUG VEHICLES, POWER TURNS AND U-TURNS
Any person who contravenes any provisions of Subsections 4 (e) (1), 4(g) and 4(k)(1) of
this bylaw shall be liable on summary conviction to a penalty of:
(i)

(1)
A police officer, designated officer or any other person appointed to carry out the
provisions of this bylaw, upon discovery of a vehicle in contravention of this bylaw
may place a parking infraction notice on the vehicle.

(2)
Where a parking infraction notice is placed on a vehicle by a police officer,
designated officer or any other person appointed to carry out the provisions of this
bylaw, the owner;
(i)
May pay the early payment as indicated on the parking infraction notice; or
(ii) Shall pay the set fine as indicated on the parking infraction notice; or
(iii) Exercise Option 2 of the parking infraction notice, regarding appeal.
(3)
A notice of Violation shall be in Form 1, Appendix 11, attached to and forming part
of this bylaw or a Provincial Summary Offence Ticket.
(4)
A person who contravenes any of the provisions of Section 4(f) of this bylaw or fails
to comply with any notice or order given there under shall be guilty of an offence
and upon conviction, shall be liable to penalties as set out in Appendix 16, or under
the General Penalty Bylaw of the Municipality.
(d)
WEIGHT RESTRICTIONS
(e) BICYCLES
(1)
A person who contravenes the provisions of subsections 4(1)(1) and/or 4(1)(2) is
guilty of an offence and liable on summary conviction to a penalty of not more than
$500.00 for the first and subsequent offence.
(2)
A further penalty shall be imposed as follows:
(i)
Three dollars for each fifty (50) kg or fraction thereof for the first thousand
(1000) in excess of the prescribed maximum gross weight allowable; and
(ii) Five dollars for each fifty (50) kg or fraction thereof in excess of one-thousand
(1000) kg that the actual gross weight exceeds the prescribed gross weight
allowable, provided that in computing the further penalty, five-hundred (500) kg
or two percent of the maximum gross weight fixed by this bylaw, whichever is
the lesser, shall not be taken into account.
(3)
In each instance, the total fine shall not exceed the maximum provided for in the
General Penalty Bylaw of the Town of Southey.
The penalty for the contravention of sections 4(n)(l), 4(n)(2) and 4(n)(3) is as follows:
(i)
-for the first infraction impounding the bicycle for seven (7) days;
(ii) for the second or additional infractions impounding the bicycle for fourteen (14)
days.
(f) IMPOUNDMENT
The registered owner of a vehicle is responsible for the costs of removal and impoundment

REMOVAL & IMPOUNDMENT
(a)
Any member of the police force, designated officer or other person appointed by Council may
remove or cause to be removed any vehicle that is unlawfully placed, left or kept on any street or
lane, public parking place, or other public place, or on municipally-owned property, and to impound
or store such vehicle.
(b)
Any member of the police force, designated officer or other person appointed by Council may
remove or cause to be removed any vehicle on request of the owner, occupant, licensee or permittee
of a parking place or private land and to impound or store such vehicle.
(c)
Where a vehicle has been impounded or stored after it has been removed under subsection(a) or (b),
it may be retained at a place designated by Council for a period of thirty (30) days from date of
removal unless the cost of removal, impounding and storage are sooner paid. Upon payment of the
full cost herein, the vehicle may be released to the owner thereof.
(d)
If the costs of removal, impounding and storage are not paid within the period of thirty (30) days as
specified in subsection (c), the Municipality shall have the right to recover same from the owner of
the vehicle by:
(1)
legal action in a court of competent jurisdiction;
(2)
sale by public auction on publication of a notice designating the time and place of
sale at least fourteen (14) days prior to the sale in a newspaper circulating in the
municipality and on sending such notice by registered mail to the owner at the address
appearing on the last registration of the vehicle.

ABANDONED VEHICLES
Abandoned vehicles shall be dealt with as provided under Section 371 of The Municipalities Act.

DOUBLE LINES
No person shall cause a vehicle to cross over or make a turn on double lines on Keats Street from
Railway Avenue to Emerson Avenue except intersections.
10.
UNUSUAL NOISE (SPINNING TIRES)
No person shall operate a motor vehicle in such a manner as to cause any part of the vehicle, such as
and including mufflers, to make any unusual noise. For the purpose of this section and without
limiting or restricting the generality of the forgoing, unusual noise shall be deemed to include the
noise caused by the screeching of tires, backfiring of motors, and car radios.

REPEAL OF BYLAWS
Bylaw No.(s) 4-1989, 3-1995, 5-1995, 11-2005, 11-2019 is hereby repealed

COMING INTO FORCE
This bylaw shall come into force and take effect on the day of final passing thereof.

PERMIT FOR OPERATION OF LUG VEHICLE (SECTION 4(e)(2))

I declare that:
1.
I will use reasonable care in propelling, operating or driving such lug vehicles over the highway
to prevent any damage resulting to the highway.
2.
I will, when operating such lug vehicle over any bridge or culvert on any highway or on any
specific culvert thereon, first lay down on such culvert planks or timbers of not less than five
(5) cm in thickness or less than five (5) meters in length, such planks or timbers to be laid
lengthwise across the culvert in the direction in which the lug vehicle on both sides thereof
throughout its entire passage over such culvert.
3. I will pay for the damages caused to such highway or culvert thereon as a result of propelling,
operating or driving such lug vehicle thereon.
