## Traffic Bylaw Village of Avonlea Bylaw No. 288-22
## A BYLAW TO REGULATE THE OPERATION & PARKING OF VEHICLES
The Council of the Village of Avonlea in the Province of Saskatchewan enacts as follows;
1. This bylaw may be referred to as "The Traffic Bylaw".
2. That all the provisions and enactments set forth in this bylaw shall relate to, and be in full force and effect within the limits of the Village of Avonlea.
3. Definitions
4. (a) "angle parking means" means the parking of vehicles with the right front wheel drawn up on the right-hand side of the highway, or at a distant of not more than thirty (30) centimeters from such curb, the vehicles to be placed at an angle of fourty-five (45) degrees with the
For the purpose of this bylaw, the following terms and words shall have the following meanings:
- (b) "administrator" means the administrator for the Village of Avonlea;
- (c) "all terrain vehicle' and/or "ATV" means all-terrain vehicle as defined in The All-Terrain Vehicles Act;
- (d) "boulevard" means that portion of right-of-way that extends from the edge of the street to the property line of the adjacent property, not including the sidewalk;
- (e) "council" means the council of the Village of Avonlea.
- (f) "curb" means the dividing line of the street between that part of the street intended for use of vehicles and that intended for pedestrians whether marked with a curbstone or not;
- (g) "driver" means any person who drives or operated or is in charge of a vehicle on a public highway and includes an operator;
- (h) "heavy vehicle" means a motor vehicle with or without load which alone or together with any trailer, semi-trailer or other vehicle being towed, weighs 5500kg or more;
- (i) "highway" means a road, parkway, driveway, square, street or place designated and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area and does not include a provincial highway within the municipality as designated pursuant to the provisions of The Highways and Transportation Act, 1997;
- (i) "lug vehicles" means any vehicle with a portable engine or tractor engine having metal spikes, lugs or cleats projecting from the face of the wheels or tires thereof, or having a metal track tread;
- (k) "marking" means any pavement marking installed on the street for the guidance, regulation, warning, direction or prohibition of traffic;
- (1) "municipality" means the Village of Avonlea
- (m) "parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of the highway, or a distance of not more than thirty (30) centimeters from such curb;
- (n) "parade" means any procession or body of pedestrians, except members of the Armed forces, numbering more than 30, standing, marching or walking on any street or sidewalk or any group of vehicles numbering 10 or more, except funeral processions, standing or moving on any street;
- (o) "parking" has the meaning ascribed thereto by The Traffic Safety Act,
- (p) "parking area" means any portion of a street or surfaced or unsurfaced area indicated by signs or markings as a place for parking;
- (9) "pedestrian' means any person afoot and shall include a baby carriage or a disabled person's
- (r) "person" includes a corporation or a partnership and women as well as men;
- (s) "playground speed zone" means that portion of a street designated by a sign or signs for the control of traffic adjacent to or in close proximity to a playground;
- (t) "place of public assembly" means schools, theatres, churches, hockey and skating rinks and halls;
- (u) "power turn" means to maneuver a vehicle in such a manner to cause part of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking;
- (v) "recreational vehicle" means a self-propelled or towed vehicular type unit, primarily designed as temporary living quarters for recreational, camping or travel use and which is used solely as a family or personal conveyance and in no way used for a commercial purpose. Without limiting the foregoing, recreational vehicles include:
- a. travel trailer;
- b. cabin trailer;
- c. tent trailer;
- d. truck camper;
- e. motorhome;
- f. park trailer;
- g. fifth-wheel travel trailer; and
- h. boat trailer.
- (W) "school speed zone", means that a portion of a street designated by a sign or signs for the control of traffic adjacent to or in the close proximity to a school;
- (x) "sidewalk" means that a portion of the right-of-way designed and intended for or used by
- (y) "street" means a road, alley or other place designed and intended for or used by the general public for the passage of vehicles and pedestrians, but does not include a parking lot, whether privately or publicly owned;
- (Z) "town" means the Village of Avonlea, in the Province of Saskatchewan;
- (aa)"traffic" means the movement of pedestrians, vehicles, or livestock upon any public highways in the Town;
- (bb) "traffic sign" means any sign or marking or installed for the guidance, regulation, warning, direction or prohibition of traffic;
- (dd) "vehicle" means a vehicle, trailer, or semi-trailer or a motor vehicle as ascribed to by The Traffic Safety Act;
- (cc) "U-turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction from which it was proceeding immediately prior to the commencement of such turn;
## 4. Emergency Control Measures
- (a) A Police Officer is herby authorized to direct traffic in conformity with the provisions of this bylaw and The Traffic Safety Act.
- (b) Every person shall comply with any traffic signal or direction of a Police Officer given pursuant to this section.
## 5. Temporary Closing and Parking
(a)
- (i) Any portion of a street may be temporarily closed to vehicular traffic by the Mayor, RCMP, or by resolution of Council of the Village in order that pedestrians may have the exclusive use thereof.
- (ii) Notwithstanding any other provisions of this bylaw, the RCMP shall have the authority to temporarily prevent parking on any street or portion thereof whenever in his judgement it may be necessary in order to avoid traffic congestion, danger or accident.
- (ili) Notwithstanding any other provisions of this bylaw, the Village Foreman shall have the authority to temporarily prevent parking or stopping and/or prohibit traffic on any street or portion thereof to allow any work to be carried out by or on behalf of the Village, such work to include but not restricted to the snow removal, cleaning, repairing or maintenance on such public highway.
## 8. Signs
- Council shall cause to be erected and maintained at all stop streets in Appendix 1, at a distance of approximately three (3) meters from point of intersection, an appropriate sign containing the word "STOP", so placed to face the traffic approaching the intersection.
- (b) Council shall cause to be erected and maintained at all yield streets listed in Appendix 2, at a distance of approximately three (3) meters from point of intersection, an appropriate "YIELD" sign, so placed to face the traffic approaching the intersection.
- (c) Council shall cause to be erected and maintained appropriate signs or curb markings to indicate "NO PARKING" areas as listed in Appendix 4. Such signs or curb markings shall be visible from that part of the highway to which the restriction applies.
## 9. Protection of and Damage to Signs
No person shall deface, injure, knock down, remove, obscure or interfere with any warning or direction signs, marker, barricade, signal or light placed, erected, or maintained by the authority of the Council, RCMP, or the Village Forman under the provisions of the Bylaw.
## 10. Use of Signs Forbidden
No person unless authorized by the Council, the RCMP, or the Village Forman as herein provided shall erect or maintain on any street in the Village, any signs, marker, signal or light.
## 11. Amendment of Schedules
Any or all schedules to this Bylaw may be amended or substituted from time to time by resolution of Council and shall form part of this bylaw.
- (iv)(1) Subject to Section 7 of this Bylaw the RCMP and/or the Village Forman shall have the authority to have or cause to have, temporary signs, warning devices, pavement markings, barricades or barriers to be erected, placed, or painted upon the roadway or right-of-way of a street for the legal information of traffic on the streets, highways and lanes in the Village.
- (2) That all such signs, warning devices, pavement markings, painting, barricades or barriers erected, placed or painted upon any such roadway, street, lane or right-ofway of a public highway and presently existing or in existence shall be deemed to have been authorized by the Village Forman.
- (b) Notwithstanding any other provisions of this Bylaw the Council of the Village shall have authority to designate and locate loading zones on any street in the Village.
## 6. Streets Prohibited to Traffic
- (a) No person driving a vehicle shall drive through or enter upon any street or portion thereof which is roped, barricaded or indicated by notice or sign as being closed under the authority of the RCMP or the Village Forman.
- (b) Where any street or portion thereof is roped, barricaded or indicated by notice of sign as being closed, the person driving a vehicle shall proceed in the direction as indicated by any signs erected or placed on the street under the provisions of Section 5 (a)(iv) of this bylaw.
## 7. Authority at Council
- (a) The council shall have the right at all times to:
- (i) By resolution, authorize the erection of warning and informational signs as well as what words, if any, shall be placed thereon and to abolish or remove same, and at its discretion to substitute others in place thereof, in accordance with the intent and meaning of this section and to regulate loading time in loading zones on all public highways within the Village and to designate playground and recreational areas.
- (ii) By Bylaw, authorize the erection of traffic signs, stop and yield signs and also by Bylaw to abolish, or remove same, and at its discretion to substitute others in place thereof in accordance with the intent and meaning of this section.
## 12. Site Line Restrictions
- (a) The owner or occupant of a lot which abuts more than one street, at the intersection thereof shall not:
- (i) grow or suffer to be grown or allow the growth of any tree, shrub or any plant; or
- (ii) build or suffer to be built or maintain any fence or other structure which exceeds a height of one meter above the level of the edge of the roadway nearest and which falls within a triangle of land formed by the intersection of the two property lines on the intersecting streets and a line connecting the points on the said property lines one meter from the intersection of the said lot property line.
- (b) The Council may upon the report of a police officer that a hedge, shrub or tree situated at an intersection is dangerous to traffic, by resolution order that such hedge, shrub or tree be removed or shortened to such a height as may be deemed necessary to overcome such danger.
## 13. Parades
- (a) No parade shall be held in the Village without permission first from the Village Council who shall designate or approve the hour and route of the parade. Any person desiring to hold a parade shall apply to the Council in writing for permission not less than fourty eight (48) hours before the time set for the commencement of the parade and shall give full particulars thereof.
- (b) Where flags are carried or displayed at the head of the parade, one shall be of the same design as that flown on public buildings of Canada and of a size equal to or greater than any other flag in the parade.
- No driver of a vehicle nor any pedestrian shall cross through any parade or in any way obstruct or interfere with the same. (c)
## 14. Parking
- (a) Except as otherwise provided herein, the parking of vehicles is permitted on all highways within the municipality.
- (i) subject to subsection (i), every person parking a vehicle upon a highway within the municipality where parking is permitted, shall parallel park;
- (ii) every person parking a vehicle upon the highways in Appendix 3 shall angle park
- (b) No operator of a vehicle shall park said vehicle;
- (i) within any alley, lane or on any town boulevard;
- (ii) so as to obstruct any private driveway;
- (11i) any place where parking is prohibited, provided that the painting of a curb yellow shall, for the purpose of this Bylaw, deemed an order sign, and no person, unless acting under the instructions of the Village Foreman, or Village Council, shall paint or permit any curb to be so painted;
- (iv) in any private parking place or on any private property of which he is not the owner, occupant, licensee, or permittee, except with the consent of the owner, occupant, licensee or permittee;
- (v) no vehicle, trailer, or recreational vehicle shall be parked or left standing in such a manner that any portion of the vehicle, trailer, or recreational vehicle extends over a sidewalk or sidewalk crossing;
- (vi) within three (3) meters of the entrance of any alley or lane on all streets where parallel parking is permitted;
- (vii) within five (5) meters of a fire hydrant measured parallel to the curb;
- (vili) within five (5) meters of block corners at intersections on streets where parallel parking is permitted;
- (ix) that has a greater manufacturer's rated carrying capacity of more than 7,500 kg on any residential streets.
- (x) (a) subject to subsection (b), no person shall park any commercial vehicle designed for carrying or intended for the carrying of oil, gasoline or other inflammable, combustible or explosive material, within 30 meters from any building in the municipality used or intended for use, in whole or in part, as a place of dwelling, a hotel or place of assembly;
(b) nothing in subsection (a) shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo.
- (xi) No personal shall park an unregistered vehicle or agricultural equipment on any street, avenue, or boulevard.
- (xii) No person shall park a vehicle on any highway at one place for any period of time exceeding seventy-two (72) consecutive hours and not exceeding twentyfour (24) hours after a substantial snowfall in order to allow street clearing.
- (xiii) No person shall park a vehicle on any street or portion thereof on which parking has been temporarily prohibited by the Administrator, RCMP, Village Foreman, under provisions of Section 5(a)()(ii)(iii)(iv)
## 15. Trailer or Semi-Trailer Parked
- (a) No person shall leave a trailer or semi-trailer parked on a street which is unattached from the vehicle for moving same.
- (b) Trailers attached to a vehicle that has a manufacturer's rated carrying capacity of one ton or less may be permitted to park on a street in the Village of Avonlea for a period not exceeding two (2) hours then must be moved to an off-street location for a minimum of twenty-four (24) hours.
- (c) No Person shall park a trailer or semi-trailer on a boulevard or the area set aside for a boulevard.
## 16. Parking of Recreational Vehicles
- (a) An owner or operator of a recreational vehicle shall not park the recreational vehicle on a street in the Village of Avonlea for more than fourty-eight (48) consecutive hours following which the owner or operator shall move the recreational vehicle to an off-street location.
- (b) No owner or operator of a recreational vehicle shall park the recreational vehicle on any street pursuant to this Subsection in such a manner as to constitute a hazard to other persons using the street.
- (c) No owner or operator of a recreational vehicle shall park the recreational vehicle on a boulevard or an area set aside for a boulevard.
- (d) Any recreational vehicle parked on a street pursuant to this section shall display a current license plate.
## 17.Parking of Unlicensed Vehicles

## 18. Chalk Marks
- (a) In order to determine the time which a vehicle or recreational vehicle has been parked in a location where parking is restricted to a specific time, any person authorized to enforce this Bylaw may place an erasable chalk mark on the tread base of the tire of the parked or stopped vehicle or recreational vehicle without such person or the Village incurring any liability for doing so.
- No person shall remove an erasable chalk mark placed under Subsection a) while the vehicle or recreational vehicle remains parked in the location where it was marked. (b)
## 19. Lug Vehicles
- (a) No person shall propel, operate or drive any lug vehicle upon any highway within the municipality without first having obtained a permit from the Administrator.
- (b) The Administrator is hereby authorized to issue permits for the purpose of Section 19 (a) provided that the administrator is satisfied that the applicant will provide reasonable care in operation of the lug vehicle, that may be propelled or driven over any highway, without damage resulting to any street. ## 20. Power Turns
- (a) The operator of a vehicle shall not execute "power turns" on any street in the municipality.
## 21. U-Turns
- (a) No person shall cause a vehicle to make a U-turn between intersections, at the intersection of a street with a lane or an alley in the municipality.
## 22. Speed
- (a) Subject to subsection (b), (c), no person shall operate a vehicle in the municipality at a speed greater than forty (40) km/h.
- (b) No person shall opcrate a vehicle at a speed greater than thirty (30) km/h in the School/Playground speed zones as set out in Appendix 6.
- (c) No person shall operate a vehicle in any parking area or alley at a speed greater than twenty (30) km/h.
- (d) The provisions of subsection (a), (b) and (c) shall not apply to the operators of Fire Department Trucks or vehicles being operated by law enforcement officers or ambulances where vehicles are being operated in emergency duty and employing sirens and red flashing lights.
## 23. Towing
No operator of a vehicle shall tow more than one other vehicle at a time on any street in the Village of Avonlea.
## 24. Vehicles on Playgrounds and Public Reserves
- (a) No person shall park or drive a vehicle upon or across a playground or any area designated as Public Reserve as set out in Appendix 9 or any area of which the Village of Avonlea has control, supervision or management except for areas designated by signs or authorized under this bylaw by the Council.
- (b) The provisions of Subsection (a) shall not apply to maintenance vehicles or employees of the Village of Avonlea who are in execution of their duties.
## 25. Snowmobiles
- (a) Under the provisions of The Snowmobile Act and subject to 22(a), it shall be lawful to operate a snowmobile between the hours of 7:00am and 11:00pm on any public highway except Provincial Highway 334 within the limits of the municipality.
- (b) Notwithstanding section 22(a) of this bylaw, it shall be lawful to operate a snowmobile on the portion of Provincial Highway 334 for the purpose of crossing the Provincial Highway.
- (c) That any snowmobile operators shall yield the right of way to vehicles on Provincial Highway 334 begore crossing the highway.
- (d) that any snowmobile crossing a public highway must come to a full stop prior to crossing and must take the most direct route across the highway.
- (e) That any snowmobile entering onto a public highway shall do so from an established public highway approach when safe to do so.
## 26. Weight Restrictions
- (a) No person shall operate any vehicle weighing with or without its load more than 12,000 kg on or over the public highways as listed in Appendix 7, except to deliver goods or services; providing the route taken is the shortest distance from an adjacent truck route.
## 27. Heavy Vehicle Route-Truck Route
- (a) No person shall drive a heavy vehicle on any street or portion of a street except those set out in Appendix 8 attached hereto and forming part of this Bylaw and prohibitions against driving are hereby established upon the streets or portions thereof except those set out in Appendix 8. The streets or portions thereof as set out in Appendix 8 are hereby established as heavy vehicle routes;
- (1) provided that this subsection shall not apply to any persons operating a heavy vehicle for the Village or owned by the Village while actually in use in the service of the Village;
- (2) and provided further that this subsection shall not apply to heavy vehicles being operated for the collection or delivery of goods within the Village limits. However, a heavy vehicle proceeding to or from one point of collection or delivery shall proceed to or from such point by or to the nearest heavy vehicle route (route taken is the shortest distance from an adjacent truck route).
## 28. Penalties
Any person who contravenes any of the provisions of this bylaw is guilty of an offence and is liable on summary conviction to a fine of not more than $500.00 per infraction, in the case of a continuing offence, to a further fine of not more than $125.00 for each day during which the offence continues.
## 29. Repeal
That Bylaw No 184-89, 238-05, 262-15 are hereby repealed
## 30. Coming into force
This Bylaw will come into force and effect on the day of the final passing.
